These Terms of Service (“TOS”) apply to the use of Mobile Backstage application, which incorporate Mobile Backstage website, mobile software and certain content (hereinafter the “Service(s)”). Your use of the Services constitutes Your express acceptance of these TOS. If You do not accept these TOS You may not use the Services.
You must be at least 13 years of age in order to use the Services. If You are a minor, including at least 13 years of age but deemed a minor under the laws applicable to You, You should review these Terms of Service and any Service specific terms and conditions (such as but not limited to any end-user software license agreements) with Your parent(s) or legal guardian as well as obtain the consent of Your parent(s) or legal guardian prior to using the Services.
Please read Privacy Policy applicable to Mobile Backstage for further information on how we respect Your privacy. Your use of the Services constitutes Your express acceptance of our Privacy Policy.
The Services are available and provided to You on “as is” and “as available” basis and we disclaim, to the greatest extent permitted by law, any and all warranties, express or implied, statutory or otherwise regarding the Services. The use of the Services is at Your sole risk and expense. To the maximum extent permitted by law, in no event shall we be liable for any lost profits (whether direct, indirect or consequential), revenue, sales, data or costs of procurement of substitute goods or services, property injury, personal injury, interruption of business, loss of information, or for any special, or consequential damages, however caused. Because some countries/jurisdictions do not allow the exclusion of liability, but may allow liability to be limited, in such cases our liability shall be limited to fifty (50) euros. Nothing contained in these TOS shall prejudice the statutory rights of any party dealing as a consumer.
The Service has been fully tested but still may contain incorrect functionality or incorrect content. If You believe You have found a page containing either of these cases please contact the support.
All rights, title and interest in and to the Services are and remain the exclusive property of ours and/or third parties and are protected by international copyright and intellectual property rights laws and treaties.
Save for the non-exclusive, non-transferable, limited license granted by us to You to use the Services subject to these TOS, we and the third parties reserve all rights, title and interest in and to the Services, including all intellectual property rights therein and thereto and no rights or license, express or implied, are granted by us or its licensors’ to any intellectual property rights in and to the Services.
The use of the Services is free of charge, but You are responsible for all Your data transfer costs. It is highly recommended that the Service is used with a flat rate data plan. Please contact Your mobile operator for information on data charges in Your network.
You are fully liable for all content You post and share via these Services. We are not responsible for any content or comments Your or any user generates into these Services. We or our business partners reserve the right, but resume no obligation, to remove all content that is found defamatory, unlawful or inappropriate at our sole discretion. Aforementioned parties also reserve the right to block users whose behavior in the service is deemed inappropriate.
These Terms of Services shall, to the greatest extent permitted by law, be governed by the laws of Finland without regard to its conflict of law provisions. All disputes arising out of these Terms of Service shall be finally settled by the District Court of Helsinki, Finland.
Notwithstanding the foregoing, nothing in these Terms of Service or any Service specific terms and conditions, if any, shall prejudice the statutory rights of any party dealing as a consumer.
